# Cottage food label requirements in Wyoming

## Other requirements

- Direct sales (farmers market, farm, ranch, producer's home or office): no label text is prescribed, but the producer must inform the end consumer that the food is not certified, labeled, licensed, packaged, regulated or inspected.
- A retail space selling homemade food must inform the end consumer that the food has not been inspected AND display a sign saying so.

## Detail

Wyoming Food Freedom Act, W.S. 11-49-101 to 11-49-104. This is the loosest regime of the six. Under 11-49-103(b), homemade food produced, sold and consumed in compliance with the Act is EXEMPT from state licensure, permitting, inspection, PACKAGING AND LABELING requirements. So for ordinary direct-to-consumer sales there is no required label at all, only a duty to inform the buyer. The quoted statement is required only in the narrow case in 11-49-103(k): non-potentially-hazardous food and dairy sold at a retail location or grocery store, where the food also may not be displayed on the same shelf or display as food from a licensed establishment. Producer caps: not more than 250,000 individual food or drink products annually and not more than $250,000 gross revenue annually. Sales must occur only in Wyoming, no interstate commerce. Homemade food may not be served or used as an ingredient in a commercial food establishment. Meat has its own separate warning requirements under 11-49-103(n) and 11-49-104 (animal shares).
